Fairhaven Woodland and Water Garden – Terms & Conditions

Health & Safety – Visitor Safety

Please be aware that the site comprises natural features, including uneven ground, rabbit holes, low-hanging branches, loose twigs, and both shallow and deep areas of open water. Visitors enter at their own risk.

 

We strongly recommend that all visitors wear appropriate footwear and exercise caution while exploring the grounds. Children must be supervised at all times, particularly near water, ponds, or the car park. Supervision must be by a responsible adult.

 

No climbing or entry into restricted areas is permitted, including but not limited to structures, trees, and fenced-off areas.

 

Dogs are welcome on the premises but must always be kept on a lead and under close control. Dogs are prohibited in certain areas or during events, and all signage and staff instructions must be followed. Natural waterways may contain harmful algae; designated water bowls are provided for dogs.

 

Visitors should be aware of seasonal hazards such as ice, wet leaves, or flooding. Slips, trips, and falls can occur; the Organiser cannot accept liability for injury resulting from such incidents unless caused by our negligence.

 

Visitors with pre-existing health conditions should ensure they are fit to participate in activities such as boat trips, guided walks, or outdoor events.

 

Please note that lighting is not provided throughout the entire site; if visiting during the evening or in low-light conditions, we advise bringing a torch for your safety and convenience.

 

1. Introduction

In these Terms & Conditions, the terms “Organiser,” “We,” “Us,” or “Our” refer to The Fairhaven Garden Trust (trading as Fairhaven Woodland and Water Garden). “Admission” refers to entry to our site/premises, including but not limited to gardens, woodland areas, the private broad, the boats, visitor facilities, and any associated attractions, experiences, or events. By purchasing a ticket or otherwise gaining entry, you agree to be bound by these Terms & Conditions.

 

2. Admission & Ticketing Rules

  1. Nobody will be allowed admission to the gardens or on to the boats without a valid ticket or pass. Tickets are non-transferable unless specifically allowed by the Organiser.

  2. For the safety of people at the site, the venue management and the Organiser reserve the right to refuse admission and conduct security searches as deemed appropriate.

  3. Official carers are admitted free of charge when attending with the person they are assisting. Evidence of official carer status will be required.

  4. If an event is rescheduled, the Organiser will give you the options of either retaining or exchanging your tickets for the new date. If an event is cancelled, you may be offered the option to transfer your ticket to a future event or a refund on your tickets.

  5. The Organiser cannot be held responsible for any resulting costs you may incur for travel, accommodation, or other goods, services, or compensation in the event of rescheduling, change, move, or cancellation.

  6. Defaced or altered tickets or passes will become void, and the holder will be refused admission.

  7. Tickets cannot be resold for commercial gain. If we have reason to believe that tickets have been re-sold, they will be invalidated, and the holder will be refused admission.

  8. The Organiser reserves the right to alter or vary the content or timing of any part of an event in circumstances beyond its reasonable control without any obligation to make any refunds or exchange tickets.

  9. The Organiser reserves the right to refuse admission or to eject any person appearing to be intoxicated, under the influence of drugs, behaving dangerously or inappropriately, for example climbing structures, feeding wildlife, or reckless conduct, or for any other behaviour likely to cause damage, injury, nuisance or annoyance, or for failure to comply with the reasonable request of the Organiser.

  10. Neither the Organiser nor any event operator will be responsible for any loss, damage, death, or injury howsoever caused unless (i) the relevant party has breached its legal obligations; and (ii) such loss or damage is a direct and reasonably foreseeable result of the breach. For clarity, this aligns with the Occupiers’ Liability Act 1957 and UK law.

  11. If all or any of an event is planned to take place outdoors it will take place regardless of weather conditions unless deemed unsafe by the safety officer. The safety officer’s decision is final. We strongly advise that you come dressed appropriately for an outdoor event.

  12. From time to time, parts of or all of the gardens may be closed due to safety concerns, maintenance, or repair work. We apologise for any inconvenience and thank visitors for their understanding.

  13. The Organiser does not accept any responsibility for any loss or damage to personal property brought to the premises. Vehicles are parked at the owner’s risk. The Organiser does not accept responsibility for theft, damage, or loss in the car park.

  14. Visitors may be filmed, photographed, or sound recorded for broadcast, publication, or security purposes whilst on the premises by the Organiser and our trusted sponsors and partners. If you do not consent to photography, please notify staff on arrival.

  15. It is a condition of your admission that no commercial (non-private) use may be made by you of the event or any part of it.

  16. Unless specified, visitors are not permitted to bring animals to an event with the exception of guide, assistance, and hearing dogs.

  17. Please check event details and timings prior to travelling as these may be subject to change.

  18. Please check your route prior to travelling to events to ensure you arrive on time. The Organiser is not responsible for any delays due to travel disruptions.

  19. For events, every effort will be made to admit latecomers, but admission cannot always be guaranteed. Entry cut-off times may apply for safety reasons.

  20. For ticketed events, refunds will only be issued if the event is cancelled by the Organiser. Outdoor events may be cancelled in the interest of safety due to severe weather, including high winds. In such cases, we will make every reasonable effort to notify ticket holders and offer either a refund or transfer to a rescheduled date. No refunds are given for non-attendance or when the event proceeds as planned.

 

3. Legal

  1. The relevant United Kingdom law will apply to these Terms & Conditions, and the relevant courts of the United Kingdom will have exclusive jurisdiction. These Terms & Conditions constitute the entire agreement between the Organiser and the visitor.

  2. Visitors must comply with any applicable public health guidance while on site, including COVID-19 or other health regulations as required.

  3. The Organiser reserves the right to update these Terms & Conditions at any time; please check our website for the latest version.
